Unpaid Wages: Minimum Wage
Employees are entitled to the federal or state minimum wage, whichever is higher. The Maryland state minimum wage is higher than the federal and that is what employers must pay. There are some exceptions to the rule, for example, those who receive a tip as part of their work may receive less in an hourly wage, but, their wage plus tips must equal at least the minimum wage. Unpaid Wages: Overtime Pay
Employees who work more than a certain number of hours in any one work week are entitled to over-time pay. There are some exceptions to the rule, and the number of hours over which overtime must be paid varies with the industry.
Although Maryland is an “at-will” state, meaning employers do not have to have a reason to fire employees, they may not do so if it violates public policy, is for an illegal reasons or is in violation of the employment contract. Examples of illegal reasons are:

- Retaliation for filing a workers’ compensation claim.
- Retaliation for asserting the right to be paid minimum wage.
- Retaliation for asserting the right to be paid for lost overtime pay.
